Terms of Service
These Terms of Service govern your use of the Oregon Handyman Pros website and your requests for or purchase of services. Our company provides home improvement, repair, installation, maintenance, assembly, and exterior services, including Property Maintenance, Plumbing, Electrical, Handyman, Garage Door, Security Camera and Smart Home, Flooring, Deck and Patio, Drywall and Painting, Fence, Siding, Office Furniture, Pressure Washing, Appliance, Carpentry, and related work. By using our website, requesting an estimate, approving a proposal, or accepting services, you agree to these Terms and any applicable written proposal, estimate, work order, or invoice.
1. Acceptance of Terms
You represent that you are legally able to enter into an agreement and have authority to approve work at the property. If you act for an owner, tenant, business, association, or other person, you confirm that you are authorized to do so. If a written proposal or project-specific agreement conflicts with these Terms, the project-specific writing controls only for that project. We may update these Terms from time to time by posting a revised version on our website; continued use after an update constitutes acceptance to the extent permitted by law.
2. Service Description
Services are based on the information available when an estimate or proposal is prepared. Estimates may be subject to site conditions, material availability, access, measurements, concealed conditions, code requirements, and changes requested by the customer. Unless expressly stated otherwise, an estimate is not a guarantee of final cost or completion date. Work may require permits, inspections, licensed trades, utility coordination, engineering, or other third parties, and responsibility for those matters will be identified in the applicable proposal.
We may use employees, qualified independent contractors, suppliers, or specialty professionals. Materials may be substituted with reasonably comparable materials when the specified item is unavailable, subject to customer approval when required. Additional work must be approved before it is performed when reasonably practicable. Emergency, concealed-condition, or safety-related work may require immediate action to protect people or property, with notice provided as soon as practical.
3. User Responsibilities
You must provide accurate project information, safe and timely access, parking or entry instructions, working utilities, and a reasonably safe work area. You are responsible for removing or protecting valuables, fragile items, pets, furniture, and personal property unless our written agreement states otherwise. You must identify known hazards, asbestos or lead concerns, water, gas, electrical, structural, pest, or environmental conditions, and any building or association rules.
You must obtain approvals that are assigned to you, make selections and decisions promptly, and pay invoices according to the agreed terms. Delays caused by access problems, late selections, unavailable materials, weather, inspections, suppliers, utility interruptions, or conditions outside our reasonable control may extend the schedule and increase costs. You may not interfere with personnel, direct subcontractors outside the agreed scope, misuse installed systems, or request unsafe, unlawful, or code-violating work.
4. Liability Limitations
To the fullest extent permitted by law, our company will not be responsible for indirect, incidental, special, exemplary, consequential, or punitive damages, lost profits, loss of use, loss of data, business interruption, or damage caused by conditions outside our control. We are not responsible for pre-existing defects, concealed conditions, normal wear, customer-supplied materials, unauthorized alterations, misuse, lack of maintenance, or work performed by others. We do not guarantee that a repair will prevent future failure where the underlying system is aged, defective, or beyond the agreed scope.
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, willful misconduct, or rights that cannot be waived. Any claim should be reported promptly with sufficient details and a reasonable opportunity to inspect and correct the issue. To the extent legally permitted, the customer agrees that any claim relating to services must be brought within the period allowed by applicable law and that recovery will be limited to the amount paid for the specific services giving rise to the claim, except where prohibited by law.
5. Warranty Disclaimers
Unless a written proposal, invoice, manufacturer warranty, or applicable law provides otherwise, services and materials are provided on an as-is and as-available basis after completion. We disclaim implied warranties to the fullest…
